Question

CAN A PERSON WILL HIS 33% OF ENTIRE PROPERTY IN THE NAME OF THE WIFE OF HIS ONE OF THE SONS.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

A bequest of one third may be made only after burial expenses and paying of debts. Accordingly, it is not permissible to bequeath 33 % of the entire property before burial expenses and before paying the debts.

It is permissible to make a bequest for a daughter in laws as she is not an heir. . [1] [2] [3] [4]. [5] [6] [7]

However you indicate that you have other sons and daughters in law. We advise you to consider the negative consequences of making a bequest in favour of one daughter in law to the exclusion of others. Undue favouritism could lead to animosity and disunity.
