What To Do With The Remainder From A Wasiyyat Totalling Less Than A Third Of The Estate
Question
A person makes Wasiyyat that one third of a person’s Kaffarah for Salaah be paid from the estate.
What if the Kaffarah works out less than 1/3rd? What will be done with the balance of the one third?
Answer
If the Fidyah calculated turns out to be less than one third of the deceased’s estate, then that which is left from the one third will be added to the rest of the estate and then distributed among the surviving heirs, according to the shares.

(قوله لا الزيادة عليه إلخ فإذا أوصى بما زاد على الثلث ولم يكن إلا وارث يرد عليه وأجازها فالبقية له وإن أجاز من لا يرد عليه ففرضه في البقية، وباقيها لبيت المال فلو أوصى بثلثي ماله وأجازت الزوجة فلها ربع الثلث واحد من اثني عشر مخرج الثلثين وربع الباقي، ولبيت المال ثلاثة ولزيد ثمانية وتمامه في شرح السائحاني على منظومة ابن الشحنة في الفرائض، وإن لم تجز وأوصى لها أيضا أولا فقد أوضحه في الجوهرة فراجعها
