Punishment For Blaspheming Nabee Sallallahu Alayhi Wa Sallam
Question
If some one does blasphemy against Hazrat Mohammed (Sallallahu Alaihi Wa Sallam) or uses derogatory language for his character, then what should be his punishment?
Answer
Anyone who swears or disrespects Nabi Sallallahu Alayhi Wa Sallam is out of the fold of Islam, and will be considered a Murtad.
If done in an Islamic state then the law is that the person will be jailed for three days, and during this time he will be asked to retract his statement and make Taubah (repent), if he does not do this, then after three days he will be killed, and as soon as he made the statement and became a Murtad his Nikaah breaks, if he now does make Taubah (he repents) then he will have to renew his Nikaah.
In order for the Islamic law to be implemented there are conditions that need to be fulfilled, like for example it has to be in an Islamic state that has an Imam etc. which are not found in South Africa, therefore the most that can be said is that the person has become a Murtad, and his Nikaah has broken, therefore it is necessary for him to make sincere Taubah (repentance) in order for him to come back into the fold of Islam, and if he does make Taubah (repent) then he will have to renew his Nikaah. The people of the community should cut off all relations with him, and stop speaking to him until he does not retract his statement, and make Taubah.

جس شخص شان اقدس ﷺ میں (نعوذ باللہ ) گالی بکے وہ مرتد اور خارج از اسلام ہے ، اسکو تو بہ اور تجدید ایمان و تجدید نکاح لازم ہے اگر وہ تو بہ نہ کرے تو واجب القتل ہے۔۔۔ لیکن اس حکم پر عمل کے لئے شرائط ہیں انکا بھی لحاظ چاہئے
