Nikaah Breaking Due To Irtidaad
Question
Q1) A person became Murtad (Allah forbid!) Is his wife required to serve Iddat?
Q2) If he issues a subsequent Talaaq during the Iddat, will it be effective?
Answer
A1) If a man divorces his wife after becoming Murtad whilst the wife is still serving her Iddat then the divorce/s will be effective. However, if he divorces her after the Iddat terminates, then Talaaq will not take place due to his wife becoming a stranger to him.
A2. If the husband became Murtad then it will be necessary for the wife to sit in Iddat.

سوال : اگر کوئی عورت مرتد ہو جائے اور نکاح فسخ ہو جائے تو عدت واجب ہوگی یا نہیں؟ اور اگر شوہر نے دوران عدت تین طلاق دیدی تو عورت مغلظہ ہو جائیگی یا نہیں؟ بینوا توجروا۔
الجواب : صورت مسئولہ میں عورت پر عدت لازم ہے اور عدت ختم ہونے سے پہلے تین طلاق دیدی تو نافذ ہو جائے گی اور عورت مغلظہ ہو جائے گی لیکن اگر عدت ختم ہونے کے بعد تین طلاق دی تو نافذ نہیں ہوگی کیونکہ عورت اجنبیہ کی طرح بن گئی ۔ (فتاوے دار العلوم زکریا 9 /683)
وأفاد وجوب العدة سواء ارتد أو ارتدت بالحيض أو بالأشهر لو صغيرة أو آيسة أو بوضع الحمل كما في البحر (الدر المختار و حاشية ابن عابدين 3/194)
قال في الفتح: ويقع طلاق زوج المرتدة عليها ما دامت في العدة لأن الحرمة بالردة غير متأبدة فإنها ترتفع بالإسلام فيقع طلاقه عليها في العدة مستتبعا فائدته من حرمتها عليه بعد الثلاث حرمة مغياة بوطء زوج آخر (الدر المختار و حاشية ابن عابدين 3/193)
