Question

Would it be permissible to ask one’s ex-wife to return the gifts given to her at the time of Nikaah?

Answer

It is not permissible for any of the parties to demand the return of the gifted items, whether after the Nikaah, or after a divorce takes place. The norm (Urf) in current times is that when the groom’s party gives the bride some jewellery, it is given to her by way of ownership (i.e. she is made the owner of it). It is not given to her as a loan. Hence, it will not be permissible for the groom’s party to ask for the gift to be returned.

Also, consider the following Aayah and Hadith:

“And if you wish to replace one wife with another and you have given one of them a great amount of wealth, then do not take back from it anything. Would you take it back by slander and manifest sin?”

Ibn Abbas Radiallahu Anhuma reported that Rasulullah Sallallahu Alaihi Wasallam said: “One who takes back his gift (which he has already given) is like a dog that swallows its vomit.”
