Watanul Iqaamah
Question
We are from Middelburg and currently studying in Benoni in a boarding Madrassah. The distance between Middleburg and Benoni is +-120km. We stay 5 days in Benoni and go home for the weekend (staying 2 days at home).
Can I make Benoni my second home town and read full Salaah there, and in Middelburg (my home town) since I stay at the Madrassah for a longer period of time i.e. 5 days?
Answer
You can make an intention to stay in Benoni for 15 days once. Thereafter, you will not need to renew your intention as long as you leave some of your belongings in your dormitory at the Madrassah. This is the opinion of many of our Senior Fuqaha such as Mufti Rashid Ahmad Ludhyanwi and Mufti Radha ul Haq. Thus, Benoni can remain your Watanul Iqaamah.

و لا يزال يقصر حتى يدخل مصره أو ينوي إقامته نصف شهر ببلد أو قرية و قصر إن نوى أقل منه

وَهَذَا بِخِلَافِ الْمُسَافِرِ إذَا نَوَى الْإِقَامَةَ فِي مَوْضِعٍ صَالِحٍ لِلْإِقَامَةِ حَيْثُ يَصِيرُ مُقِيمًا لِلْحَالِ؛ لِأَنَّ نِيَّةَ الْإِقَامَةِ هُنَاكَ قَارَنَتْ الْفِعْلَ وَهُوَ تَرْكُ السَّفَرِ؛ لِأَنَّ تَرْكَ الْفِعْلِ فِعْلٌ فَكَانَتْ مُعْتَبَرَةً … وَأَمَّا بَيَانُ مَا يَصِيرُ الْمُسَافِرُ بِهِ مُقِيمًا: فَالْمُسَافِرُ يَصِيرُ مُقِيمًا بِوُجُودِ الْإِقَامَةِ، وَالْإِقَامَةُ تَثْبُتُ بِأَرْبَعَةِ أَشْيَاءَ: أَحَدُهَا: صَرِيحُ نِيَّةِ الْإِقَامَةِ وَهُوَ أَنْ يَنْوِيَ الْإِقَامَةَ خَمْسَةَ عَشَرَ يَوْمًا فِي مَكَان وَاحِدٍ صَالِحٍ لِلْإِقَامَةِ

عبارات پر غور کرنے سے معلوم ہوتا ہے کہ وطن اقامت سے محض سفر کرنا ہی مبطل نہیں بلکہ در اصل سفر بصورت ارتحال مبطل ہے- یعنی یہ بطلان اس وقت ہوگا جبکہ وطن اقامت سے بنیت سفر جاتے وقت اپنا سامان و غیرہ بھی ہمراہ لیجائے جس سے یہ سمجھا جائے کہ شخص مذکور کا ارادہ فی الحال یہاں واپس آنےکا نہیں ہے
