Haidh Prior To Talaaq
Question
A lady’s Haidh commenced. A few minutes later, she received a phone call wherein her husband issued three Talaaqs to her. Will she count her Haidh from this cycle, or the next one?
Answer
If the bleeding continues for more than 3 days, then this will be regarded as Haidh. Now, since this bleeding came prior to the date of Talaaq, this bleeding cannot be considered as the first Haidh cycle of your Iddah.

(إذا طلق الرجل امرأته) المدخول بها سواء كان (طلاقاً بائناً أو رجعياً أو وقعت الفرقة بينهما بغير طلاق) كأن حرمت عليه بوجه من الوجوه السابقة: كتمكين ابن الزوج, ونحو ذلك مما يوجب الفرقة (وهي حرة) و (ممن تحيض فعدتها ثلاثة أقراء) كوامل من وقت الطلاق أو الفرقة, فلو طلقت في الحيض لم يعد من العدة, (والأقراء) هي (الحيض) عندنا, لأن الحيض معرف لبراءة الرحم, وهو المقصود

ومنها (أي من الأمور التي يتوقف عليها كون الدم حيضا) خُرُوجُ الدَّمِ إلَى الْفَرْجِ الْخَارِجِ وَلَوْ بِسُقُوطِ الْكُرْسُفِ فَمَا دَامَ بَعْضُ الْكُرْسُفِ حَائِلًا بَيْنَ الدَّمِ وَالْفَرْجِ الْخَارِجِ لَا يَكُونُ حَيْضًا. هَكَذَا فِي الْمُحِيطِ. (الفتاوي الهندية 1/36)
