Maintaining A Child Living Separately
Question
If a child opts to live with the mother, is the father liable to pay maintenance for that child? The father maintains their other children who reside with him and cannot afford to pay separately for the child.
Answer
It is the father’s responsibility to provide for the maintenance of the children, irrespective of where they are staying. If he fails to do so, then due to the absence of a Qadhi, you should approach a reputable Darul Ifta or Jamiat in your town to contact your husband who will compel him to give maintenance for your children, even if he has to sell scrap metals. Furthermore, a loan can be obtained on his name if he cannot afford the maintenance. In an Islamic ruling country, the father may even be imprisoned for not providing maintenance for his children.
