Leasing Out Premises To Sinful Vendors
Question
Is it permissible to lease a space in a commercial shopping centre for the following activities:
1. Bank
2. Money-loaning company
3. Church
4. Liquor store
Answer
Leasing out to any of the above ventures will not be permissible due to it being a means of assisting in sinful actions. Allah Ta’ala says in the Quraan Majeed:
“And do not assist in sin and transgression.” [Surah Maa’idah, Verse 2)

وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ
سوال: مکان وغیرہ ایسے لوگوں کو کرایہ پر دنیا کہ جو شراب و دیگر محرمات اس میں فروخت کرتے ہوں یا خود افعال خلاف شرع ممنوعات اُس میں کریں یا کفار کہ وہ اس میں بت پرستی کریں، منع اور داخل اعانت على المعصیت ہو گا یا نہیں ؟
جواب : ایسے کو کرایہ پر دینا مکان کا درست نہیں حسب قول صاحبین کے اور امام صاحب کے قول سے جواز معلوم ہوتا ہے کہ مکان کرایہ پر دینا گناہ نہیں گناہ بفعل اختیاری مستاجر کے ہے مگر فتویٰ اسی پر ہے کہ نہ دیو ے کہ یہ اعانت گناہ کی ہے ۔ لا تعاونوا علی الاثم والعدوان – فقط واللہ تعالیٰ اعلم.(تاليفات رشيديہ ص421)
قال ولا يجوز الاستئجار على الغناء والنوح وكذا سائر الملاهي لأنه استئجار على المعصية والمعصية لا تستحق بالعقد (هداية 3/303)
