Question

Is ʿUshr compulsory on produce grown in South Africa? Are the lands of South Africa deemed ʿUshrī lands?

Answer

In the Name of Allāh, the Most Gracious, the Most Merciful.

Land that falls under the jurisdiction of a non-Muslim government and has never at any stage been ruled by a Muslim government is not considered ʿUshrī land.

Accordingly, ʿUshr is not compulsory on the produce grown in South Africa, even if a Muslim has purchased the land and is considered to be its lawful owner.

And Allāh Taʿālā knows best.
