Distribution of the Meat in the Qurbaani Animal
Question
Two brothers want to share a cow for Qurbaani. Ahmed wants four shares and Yusuf wants three. Ahmed says he does not mind when sharing they will both take half of the cow each. Is this jaaiz?
Answer
The more safer approach will be that you receive your proportionate share and thereafter you may make over that amount that you desire to your partner.

ويقسم اللحم وزنا لا جزافا
و فى رد المحتار: قوله ( لا جزافا ) لأن القسمة فيها معنى المبادلة ولو حلل بعضهم بعضا قال في البدائع أما عدم جواز القسمة مجازفة فلأن فيها معنى التمليك واللحم من أموال الربا فلا يجوز تمليكه مجازفة وأما عدم جواز التحليل فلأن الربا لا يحتمل الحل بالتحليل ولأنه في معنى الهبة وهبة المشاع فيما يحتمل القسمة لا تصح وبه ظهر أن عدم الجواز بمعنى أنه لا يصح ولا يحل لفساد المبادلة (رد المحتار 6/317)
