Suspending the talaaq upon the wife speaking to her friend
Question
If a man puts a condition for his wife that if she talks to her friend who was creating problems in their marriage life then she is divorced. The wife did not talk to her but replied to her text message. By doing this, does divorce happen? Please guide.
Answer
If the husband's intention was that if his wife verbally communicates with her friend then she will be divorced, then in this case no talaaq has taken effect since she did not verbally communicate with her friend. However, if the husband's intention was that if his wife has any type of contact with her friend or communicates with her in any way then she will be divorced, then in this case the talaaq has taken place. Hence, the husband should be questioned regarding his intention at the time of suspending the talaaq.
