Bay'us salam (forward sale)
Question
When Nabi (sallallahu alaihi wasallam) came to Madina, the people used to pay in advance the price of dates to be delivered within two or three years. He said (to them), ‘Whoever pays in advance the price of a thing to be delivered later should pay it for a specified measure at specified weight for a specified period’”(Bukhari no: 2239).
I read this quotation in a book. Can I know how it is done according to mazhab of Shaafee?
Answer
This is called bay`us salam. Among the preconditions for the validity of this type of a sale is that the sale item be known and specified in weight and type, the price should be fixed and paid and the time of delivery needs to be specified.
And Allah Ta'ala (الله تعالى) knows best.
