Question

The stock, fittings, etc. in my business are worth R300 000. Is it permissible for me to charge R50 000 goodwill and sell my business for R350 000?

Answer

Goodwill, in reality, is a payment for the name of the store. It is not permissible to pay for a name. For a sale to be valid, it is necessary that the sale item be regarded as maal (wealth) in Shari’ah and that its sale also be approved of by Shari’ah. Since a right is not maal (wealth), it can neither be bought nor sold. If you wish, you may charge the entire amount of R350 000 for the store and the existing stock in the store. In this way, the sale will be valid.

And Allah Ta'ala (الله تعالى) knows best.
