Meaning of revocable divorce
Question
What is the meaning of revocable divorce?
Answer
It refers to the divorce which is issued using a clear word of divorce (e.g. "I divorce you" or "I give you talaaq").
The effect of such a divorce is that the talaaq takes place but the husband has the right to revoke (retract) the talaaq as long as the wife is in the iddat.
Once the iddat period passes, the nikaah is terminated and the husband will no longer have the right to revoke the talaaq and take her back in his nikaah. Thereafter, if both mutually wish to reunite, then a new nikaah will have to be performed with a new mahr.
Note:
1) Even though the husband revokes the talaaq, since the talaaq was issued, the number of talaaqs remaining will decrease (e.g. if this is the first talaaq issued by the husband, then only two talaaqs will remain).
2) If the talaaq issued by the husband is the third talaaq, then in this case, the husband will not have the right to revoke the talaaq and take the wife back into his nikaah in the iddat period. Similarly, they will not be able to remarry after the iddat period terminates.
After the third talaaq is issued, the wife becomes haraam upon the husband. Until halaalah does not take place, the husband and wife will not be able to remarry.
And Allah Ta'ala (الله تعالى) knows best.
