Performing Salaah in Musjidul Khaif
Question
When one is in Mina during the days of hajj, should he perform his fardh salaah with jamaat in Musjidul Khaif behind the appointed imaam of the musjid?
Answer
If the imaam is a muqeem but he makes qasr (i.e. he performs two rakaats instead of four) in the Zuhr, Asr and Esha Salaah (as it is permissible for a non-musaafir to make qasr in hajj according to the Maaliki Mazhab ), then it will not be permissible for a Hanafi to follow such an imaam in salaah.
And Allah Ta'ala (الله تعالى) knows best.

قال مالك: بلغني أن القاسم بن محمد وسالم بن عبد الله يفتيان بقصر الصلاة بمنى وعرفة قال مالك: وحدثني نافع أن ابن عمر كان يصلي ركعتين بمنى وعرفة، إلا أن يصلي مع الإمام فيصلي بصلاته.قال محمد بن رشد: معناه أنهما كانا يفتيان من حج من أهل مكة أو كان مقيما بها من غير أهلها بقصر الصلاة بمنى وعرفة، كما كان يفعل ابن عمر في رواية نافع. وهو مذهب مالك (البيان والتحصيل 17/221)
فالحق ما عليه الجمهور أن القصر بمنى وعرفات كان للسفر لا لكونه من مناسك الحج (إعلاء السنن 10/411)
