Inheritance

Question

There is a dispute which is currently taking place between some family members regarding a certain property which is part of the estate of their great grandfather.

One female is part of the present heirs and is receiving a share of the property. However, one family member who is also an heir wants to buy her share against her will and take her share for his own benefit. Is this permissible?

Answer

It is not permissible for any heir to force another heir to sell his share against his will. Hence, in this case, it is not permissible for the family member to force his female relative to sell her share to him when she is not happy to do so. This is haraam and oppression.

And Allah Ta'ala (الله تعالى) knows best.
