Performing one's own Nikaah secretly
Question
My friend performed his nikah (khutab) himself in presence of two male witness, is this nikah valid?
Answer
It is a sunnah of Rasulullah (Sallallahu Alaihi Wasallam) that the nikah be publicized. Hence the Ulama have written that it is preferable to perform the nikah in the Musjid (in the presence of the Muslim congregation). However if the nikah was performed in the presence of two Muslim, baaligh, male witnesses, the nikah will be valid.

وأما شروطه... ومنها الشهادة قال عامة العلماء إنها شرط جواز النكاح هكذا في البدائع وشرط في الشاهد أربعة أمور الحرية والعقل والبلوغ والإسلام... ويصح بشهادة الفاسقين والأعميين كذا في فتاوى قاضي خان... ويشترط العدد فلا ينعقد النكاح بشاهد واحد هكذا في البدائع ولا يشترط وصف الذكورة حتى ينعقد بحضور رجل وامرأتين كذا في الهداية ولا ينعقد بشهادة المرأتينبغير رجل وكذا الخنثيين إذا لم يكن معهما رجل هكذا في فتاوى قاضي خان ومنها سماع الشاهدين كلامهما معا هكذا في فتح القدير (الفتاوي الهندية 1/295-296)
قال ولا ينعقد نكاح المسلمين إلا بحضور شاهدين حرين عاقلين بالغين مسلمين رجلين أو رجل وامرأتين عدولا كانوا أو غير عدول أو محدودين في القذف. (الهداية 2/306)
