Question

if imam is a shafee and the broader public is hanafi whats the ruling?

Question posed by: Haafiz Saheb, Durban

Answer

In principle, it is permissible for a Hanafi to follow a Sunni Saheehul Aqeedah, Baa Shara'a (adhering to the Shariʿah) Imam who follows the Shaafi'i school of thought. However, this permissibility is not based merely on the Imam being Shaafi'i or the follower being Hanafi. Rather, it depends on whether the Imam observes the Hanafi rulings in those issues of Salaah and purification (Tahaarat) in which there are juristic differences that affect the validity of Salaah and purification. Therefore, if the Shaafi'i Imam observes the Hanafi requirements in such matters, then the Salaah of Hanafis behind him is valid without any dislike (Karaahat), whether the followers (Muqtadi) are many or few. But if it is known that he does not observe those requirements, then it is not valid for a Hanafi to follow him. The fundamental principle of this issue is that mere difference in Madhhab does not in itself prevent following an Imam. Rather, the decisive consideration is whether the Imam’s Salaah is also valid according to the Madhhab of the follower (Muqtadi). For this reason, Hanafi jurists have permitted following an Imam of another Madhhab, subject to certain conditions.

It is stated in Ghunyah:

Translation: “Following one who differs in secondary juristic issues, such as a Shaafi'i, is permissible so long as nothing is known from him that would invalidate the Salaah according to the belief of the follower. There is consensus on this permissibility, though scholars differ regarding the issue of dislike (Karaahat).” (Ghunyatul Mutamalli Fi Sharh Munyatul Musalli, Page 516 / Chapter of Imaamat) This shows that the essential condition is that the Imam should not be known to do anything which, according to the follower’s belief, would invalidate the Salaah or purification. Accordingly, if a Shaafi'i Imam, for example, performs wiping of less than one-fourth of the head, or does not perform Wudu after bleeding, or leads Salaa without Wudu after a mouthful of vomiting, or neglects any matter which the Hanafis consider to be among the conditions or pillars of purification and Salaah, and the Hanafi follower is aware of this, then following him is not permissible, because in the follower’s belief the Imam’s Salaah is not valid. In Durr e Mukhtaar it is stated:

Translation: “If it is certain that he observes the Hanafi position, then following a Shaafi'i Imam is not Makrooh. If he does not observe it, then following him is invalid. If there is doubt, then it is Makrooh.

Under this, it is stated in Shaami (Raddul Muhtaar):

Translation: “The statement ‘if it is certain that he observes’ refers to observance of the obligatory elements such as conditions and pillars of Salaah, even if he does not observe the Hanafi position regarding the Waajibaat and Sunnahs, as is apparent from the context of Al Bahr and likewise from Sharhul Munyah.” (Fataawa Shaami, Volume 2, Chapter of Salaah, Baabul Imaamah/Zia-ul-Quran Publications, Lahore) This makes it clear that “observance” here does not refer to every minor juristic difference, but specifically to those matters which the Hanafis classify as conditions, pillars, and essential requirements of Salaah and purification. Further elaborating upon this issue, Imam e Ahle-Sunnat, Sayyidi Ala Hazrat, Imam Ahmad Raza Khan Alaihir Rahma, outlined the following rulings according to various circumstances: 1. If, regarding a particular Salaah, it is known that the Imam failed to observe a condition or obligation of Wudu, Salaah, or Imaamah according to the Hanafi school, then the Salaah of a Hanafi behind him is completely invalid.

2. If the state of that particular Salaah is unknown, but it is known from the Imam’s usual practice that he generally does not observe the relevant Hanafi requirements, then performing Salaah behind him is Makrooh e Tahreemi. 3. If even his usual practice is unknown, then following him is Makrooh, and the stronger opinion is that this Karaahat is not at the level of Makrooh e Tahreemi. 4. If his established habit is that he consistently observes the Hanafi requirements, then the ruling is lighter than the previous case, although it is still not entirely free from some degree of Karaahat (dislike). 5. If it is specifically known regarding a particular Salaah that he observed all the relevant requirements, then according to the majority of scholars there is no Karaahat (dislike) whatsoever, even if his previous habit was otherwise. Nevertheless, it remains preferable, when possible, to perform Salaah behind an Imam of one’s own school. (Fataawa Razviyyah Shareef, Volume 6, Page 505/Raza Foundation, Lahore)

Summary: From the above juristic texts, it becomes clear that the validity or invalidity of following an Imam does not depend merely on him being Shaafi'i or Hanafi. Rather, it depends on whether the Imam’s Salaah is valid according to the follower’s Madhhab in those essential matters which affect the validity of Salaah and purification.

Therefore, if a Shaafi'i Imam observes those requirements which the Hanafis classify as conditions, pillars, and essential elements of Salaah and purification, then following him is permissible without dislike (Karaahat). If it is known that he does not observe them, then following him is not valid. In the case of doubt, following him is disliked (Makrooh), although the Salaah itself will still be valid.
