Zakaat On Jewellery
Question
Is there Zakaat on jewellery used by women or not?
Question Posed By: Ahmad Ally, Overport, Durban, South Africa
Answer
Zakaat becomes obligatory on all gold or silver jewellery, adornments and ornaments, whether in use or not, if it reaches the value of Nisaab (Nisaab is the fixed minimum value stipulated by the Shari’ah law upon which Zakaat is obligatory), provided that all the required conditions for Zakaat to be obligatory are met. Furthermore, all gold or silver jewellery, adornments and ornaments are not included or regarded as basic necessities. It is stated in Badaa e Al-Sanaa'i:
Translation: “Jewellery is categorised as wealth which transcends the basic needs. Rather, it is a luxury and its use is for adornment, thereby providing ample proof that it is more than a basic need, so to remove a portion from its value for the poor becomes compulsory.” (Al-Bada'i Al-Sanaa'i, Vol. 2 Pg.102)
It is stated in Fataawa Razviyyah Shareef: “Even if this jewellery is utilised for daily use (Zakaat is still obligatory on it), as it is not from a person’s basic needs to wear jewellery, i.e. there is no real need to wear jewellery.” (Fataawa Razviyyah Shareef Jadeed, Volume 10, Page 133)
