Question

1: I have been saving money for two years, to purchase a house, which is deposited in the bank. Will Zakaat be obligatory on this saving? 2: Does being excessive (i.e. using more water than necessary) in Istinja (i.e. washing after passing stool) in the state of fasting, invalidate the fast?

Question Posed By: Muhammad Zahid shaikh Chatsworth, Durban, South Africa.

Answer

(1): If the amount has reached the Nisaab and a year has passed since it reached the Nisaab, then Zakaat will be obligatory on it. It is stated in Fataawa Shaami that:

Translation: When he withholds wealth so that he may spend out of it for his needs. However, if the year passes and he has the Nisaab left from this wealth, then he will pay Zakaat from the rest, even if he intends to spend from it in the future. Zakaat will be liable because he did not use it for basic needs during the year. However, at the time of the completion of one year

(Zakaatable year), if it is necessary to spend the money for basic needs then the law will be different. (Fataawa, Shaami, Volume 3, Page 509, Book of Zakaat - Zia-ul-Quran Publications Lahore) Huzoor Sadrush-Shariah Alaihir Rahma writes in Bahaar e Shariat as follows: If money is kept to be spent on Haajaat e Asliyah (basic needs), then whatever you spent in the year is fine, but if whatever is remaining is equivalent to (or more than) the Nisaab then Zakaat is Waajib on the remaining balance, even if one kept it with the intention of spending it in future for Haajaat e Asliyah. If at the time of the completion of the year (i.e. your Zakaatable year) there is a need to spend it for Haajaat e Asliyah, then Zakaat is not Waajib (on that amount particular). (Bahar e Shariat, Part 5, Page 16 - Qadri Kitaab Ghar Bareilly Shareef)

Answer (2): Being excessive in Istinja (washing after passing stool) in the state of fasting will invalidate the fast if the water reaches the position of Huqna (the area upto where enema is administered). As it has been mentioned in Fataawa Shaami:

Translation: If a person is excessive in Istinja until the finger reaches the place of Huqna, then the fast will be invalidated. It is very rare, if so, it can cause serious illness. (Fataawa Shaami, Volume 4, Page 78 - Book of Fasting Zia-ul-Quran Publications Lahore) It has been mentioned also in Fataawa Taataar Khaniyah:

It has been mentioned in Hashiyatut Tahtawi with these words:

Translation: “Whilst cleansing oneself, the person should strive to loosen the rear orifice so that as much impurity as possible can be removed from the anus, provided one is not fasting. The person fasting, however, should not do so to prevent the fast from being invalidated. Likewise, the person fasting should avoid inserting a wet finger because it invalidates the fast. After cleansing oneself, the rear orifice should be dried before standing. This will prevent the rear orifice from gathering water thereby breaking the fast. It is also recommended so as to protect the garment from becoming wet with used water.” (Hashiyatut Tahtawi Pg.154) And in Bahaar e Shariat, it is as follows; “If one performed Istinja (washing after passing stool) by using more water than required and the water reached the area where a clyster is usually placed, then in this case the fast will be broken, and one should not use excessive water, as there is a risk of illness in this.” (Bahaar e Shariat, Part 5, Page 116 - Qadri Kitaab Ghar Bareilly Shareef) Note of Caution: When using a hand shower one should lower the pressure and be extra careful when washing because if the water does reach the internal area of the anus (where the clyster is administered) then the fast will be invalidated.
