Question

According to Sharia how is to perform Hajj with Haraam earnings?

Question posed by: Imtiaz Ali Johannesburg South Africa

Answer

It is necessary upon every Muslim male and female to live their lives in pursuit of pure earnings (Halaal Earning) and pure (virtuous) deeds (work), so that they may eat Halaal food and spend on Halaal things and so that they may abstain from Haraam and from those things which are suspected to be Haraam, because Hell is the more appropriate place for that body which has been nourished by Haraam earnings. Therefore, there are severe warnings regarding Haraam (unlawful) sustenance and Haraam earnings which have been mentioned in the Ahadith:

1) The Holy Prophet صلى الله عليه وسلمsaid: That flesh (i.e. body) which has been nourished with Haraam wealth, will not enter Paradise and such Haraam flesh is more deserving of Hell. (Tirmizi Shareef, Volume 2, Page 118; Mishkaat Shareef, Volume 2, Page 131) 2) He صلى الله عليه وسلمsaid: The Dua (supplication) of one who consumes Haraam is not accepted. (Muslim Shareef) 3) He صلى الله عليه وسلم: "No Sadaqa (Charity) which is from Haraam wealth will be accepted". (Muslim Shareef) 4) It is in the Hadith of Abu Dawood Shareef that the Messenger of Allah صلى الله عليه وسلمhas cursed those people who take and give bribes. (Abu Dawood Shareef) 5) The Ibaadat (acts of worship) and Namaaz (Prayers) of the one who eats Haraam food is not accepted (It’tihaafus Saadaatil Mut’taqeen Volume 6, Page 452) 6) It is narrated on the authority of Hazrat Ibn Umar ر ضی الہ ضیھاthat if a person buys a piece of cloth (fabric) for ten Dirhams and one Dirham in it is Haraam, then for as long as the cloth (clothing) remains on him, Allah Almighty will not accept any of his Salaah. (Miratul Manaajeeh, volume 4, page 262)

After the observation of some Hadith in the beginning regarding which condemn Haraam earnings and further condemns consuming Haraam, now take heed to the answer to the actual question which is at hand: It is impermissible and Haraam to perform Hajj with Haraam earnings or Haraam wealth. Therefore, if a person performs Hajj with Haraam earnings or Haraam wealth, then that Hajj will not be accepted, although the obligation (i.e. The Fard Act of performing the Hajj) will fall away. This is just as Huzoor Sayyidi Ala Hazrat Imam Ahmad Raza Khan یی ہ رہwrites in Fataawa Razviyyah Shareef: "To spend Haraam wealth (earnings etc.) in it, meaning in Hajj, is Haraam, and that Hajj will not be acceptable, even though the obligation will fall away (i.e. the obligation of Hajj will be counted as being discharged due to the acts of Hajj being performed, so the obligation will fall away, but the Hajj will not be an accepted one, meaning there is no reward or blessings for it). It has been mentioned in a Hadith that when a person goes to perform Hajj with Haraam wealth and when he says Lab’bayk, the Angel respond by saying:

Neither your presence nor your service is accepted and your Hajj is also rejected and thrown on your face, until such time that you return this Haraam wealth which is in your hands (i.e.in your possession)." (Fataawa Razviyyah Shareef volume 8, page 528, Chapter of Hajj, Imam Ahmad Raza Academy Bareilly Shareef) It is in Fataawa Shaami:

Translation: It is said in Al-Bahr: He will strive to acquire Halaal provisions, because Hajj is not accepted with Haraam provisions, just as it is stated in the Hadith. At the same time with this Haraam provision, the obligation will be waived from him (i.e. the obligation will fall away) and there is no contradiction between the waiving of this obligation and Hajj not being accepted. So no reward will be given to him (to the Hajee) because his Hajj is not accepted. (Fataawa Shaami Volume 4, Page 221, Chapter of Hajj/Zia-ul-Quran publications Lahore)

It is in Fataawa Hindiyah:

Translation: And he should strive to get Halaal wealth, because Hajj is not accepted without Halaal wealth even though the obligation is waived (falls away). (Fataawa Hindiyah, Volume 1, Page 243, Kitaabul Manaasik Darul Kutbul Ilmiyah Beirut) It is in Bahaar e Shariat: It is Haraam to go for Hajj with Haraam wealth. (Bahaar e Shariat, Volume 6, Page 7, Qadri Kitaab Ghar, Bareilly Shareef) In brief, it is impermissible and Haraam to perform Hajj with Haraam earnings or Haraam wealth. However, if a person performs Hajj with Haraam earnings or Haraam wealth then the Hajj will be performed (discharged), but he will not get any reward.
