Talaaq (Divorce)

Question

A couple had a dispute and the wife was asked to leave the home. The husband was approached by representatives of the wife and reminded him that, if the couple were to separate or divorce, it would be his responsibility to maintain her during the Iddah period. The husband then stated that if he were to issue a divorce, it would be a Kinaayah Talaaq which would constitute a Talaaq-e-Ba’in, and does not compel him to maintain his wife during Iddah. The representatives bear testimony that this statement uttered by the husband was not intended as Talaaq but rather informing them of the type of Talaaq he would issue in the event of divorce taking place. Did a Talaaq fall in this circumstance?

Answer

In the queried scenario, there is no clear mention that the husband issued the Talaaq. The words of the husband, “The type of Talaaq is a Kinaya Talaaq which constitutes a Talaaq Ba’in”, indicates that there was a discussion of Talaaq taking place.

Furthermore, if the wife claims that he had given her a Talaaq, then she should bring proof (2 witnesses) to prove her claim. If she fails to provide the proof, then the husband will be asked to take a Qasam. This procedure of either producing witnesses or taking an oath, must be carried out before a reliable Muslim judicial body, Darul Ifta, or Mufti.
