Talaaq (Divorce)

Question

Q1) After Talaaq and separation, is it permissible for the husband to tell his wife, “I give you one Talaaq-ur-Raj’ee, so tell your father to take you”? Shouldn’t the Iddah be in her marital home?

Q2) After the Iddah, can the wife and her family be prevented from entering the home to retrieve her belongings?

Q3) Items that he gifted her like pots, etc. will they belong to him because he paid for it?

Q4) What is the sin of not providing Nafaqah during her Iddah period after telling her to go back to her parents’ house?

Answer

A1) Yes, the Iddah will be served at the husband’s house unless there is a valid Shar’i reason.

A2) No, this is incorrect.

A3) Once he gifted the pots, etc. and the wife took possession of it, then it will not be permissible for him to take it back. However, she should ask her husband to clarify whether it was given as a gift or merely for usage.

Consider the following Hadith:

Ibn Abbas Radiallahu Anhuma reported that Rasulullah Sallallahu Alaihi Wasallam said: “One who takes back his gift (which he has already given) is like a dog that swallows its vomit.”

A4) The husband will be committing a grave sin by not fulfilling the command of Allah Ta’ala and Rasulullah Sallallahu Alaihi Wasallam. Our suggestion is that she should contact her local Jamiat or Darul Ifta and request them to converse with her husband, to advise him that he must pay maintenance for the duration of her Iddah period.
