Unnecessarily delaying the Tawaaf-e-Ziyaarah till after the days of Qurbaani
Question
What is the ruling if a haaji delayed the Tawaaf-e-Ziyaarah till after the days of qurbaani without a valid Shar’ee reason?
Answer
Delaying the Tawaaf-e-Ziyaarah till after the days of qurbaani without a valid Shar’ee reason is not permissible. If one had delayed, then one will be sinful and one damm (i.e. slaughtering one goat or sheep in the precincts of the Haram as an atonement for the violation) will be waajib upon him.

( فإن أخره عنها ) أي أيام النحر ولياليها منها ( كره ) تحريما ( ووجب دم ) لترك الواجب وهذا عند الإمكان فلو طهرت الحائض إن قدر أربعة أشواط ولم تفعل لزوم دم وإلا لا ( الدر المختار 2/518-519)
قال العلامة الشامي: وأما ما سيأتي من قول المصنف وكل ما على المفرد به دم بسبب جنايته على إحرامه فعلى القارن دمان وكذا الصدقة وذكر الشارح هناك أن المتمتع كالقارن فلا يرد على ما هنا وإن كانت جناية المتمتع على إحرام الحج وإحرام العمرة لأن المراد هناك الجناية بفعل شيء من محظورات الإحرام بخلاف ترك شيء من الواجبات كما سيأتي في كلام الشارح وهنا الجناية بترك واجب الطهارة فلا ينافي وجوب الصدقة في العمرة بفعل المحظور ولهذا لم يعمم في اللباب بل قال لا مدخل في طواف العمرة للصدقة وإن أطلق الشارح العبارة تبعا للفتح فتنبه ( شامي 2/552 )
