"If you want to leave, pack your things and go"
Question
A husband and wife have been having numerous arguments. During the course of these arguments, the husband has, on many occasions, told the wife “ if you want to leave, pack your things and go”. Does this nullify the nikah?
Answer
If the husband had intended divorce then talaaq baain will be effective.

الطلاق على ضربين صريح وكناية فالصريح قوله أنت طالق ومطلقة وطلقتك فهذا يقع به الطلاق الرجعي ... ولا يفتقر إلى النية (الهداية 2/359)
وأما الضرب الثاني وهو الكنايات لا يقع بها الطلاق إلا بالنية أو بدلالة الحال (الهداية 2/373)
