TalaaqThree TalaaqsWomen's IssuesIddat

Question

I would like to know the validity of the talaq given to me by my husband. He said talaq three times in one go out of anger. There were a few people present to hear the talaq and straight after, he called my father and said ‘I've given your daughter talaq come and take her’.

Currently we are living separately and we have three children together.

Also, when and how long does my iddah start. At the time of the talaq I was on my menses.

Answer

It is not permissible for the husband to issue talaaq to his wife when she is in the state of haidh. However, if the husband issues the talaaq, the talaaq will be valid. Hence, all three talaaqs are valid and your nikaah has terminated. You are no longer halaal for him.

Your iddat has commenced from the time he issued the talaaq. Your iddat is three complete haidh (i.e. besides the haidh wherein he issued the talaaq, when the third haidh ends, your iddat will terminate).

And Allah Ta'ala (الله تعالى) knows best.
