What the Darul Iftas say

“1. Yes, if the court issues the verdict of divorce, then the divorce will be valid, since the husband authorised the court to act on his behalf in issuing the divorce.”

Ibn Masood — Status of a civil or court divorce · 5 Oct 2023

“If your husband issues the talaaq in the court, the talaaq will be valid. He will be able to take you back in his nikaah before the termination of the iddat and thereafter he will only have two talaaqs remaining. We do not advise your husband to divorce you for such reasons.”

Mufti Online — Issuing a divorce in court to dissolve a COP marriage · 10 Jul 2017

“A divorce administered through the court process is limited to the court legally terminating the marriage and does not constitute a ṭalāq (divorce) according to the sharīʿah.”

MUBZ — Will a Legal Divorce Count as a Sharʿī Ṭalāq? · 16 Jun 2024

“The verdict of divorce given by the judge of a civil court, can only be regarded as a civil divorce and not a Shari’ Talaaq. The judge has been appointed by the country to issue verdicts in accordance to the law of the country and not in accordance to the laws of Shariah.”
