Question

1: A Sunni Hanafi scholar, while leading the funeral prayer, forgetfully raises his both hands in the four takbirs, so does the funeral prayer take place in this case or not?

Question posed by: Tahir Shaikh, Chatsworth Durban.

Answer

In the above mentioned case, the Janaazah Salaah is valid and there is no need to repeat it. However, it is against the Sunnah and it is a minor Makrooh (disliked act), because according to the Ahnaaf after the first Takbeer raising both hands on the other three Takbeers is not Sunnat. There is a narration in Sunan Daar Qutni:

Translation: Hazrat Abdullah bin Abbas Radi Allahu Anhuma narrates that the Holy Prophet used to raise His both hands in the first Takbeer in the Janaazah Salaah, then after that He did not raise His hands while saying the Takbeer in the Janaazah Salaah. (Sunan Daar Qutni Volume 3, page 192, Chapter of Janaazah, Published Shabbeer brothers Lahore) It is in Durr e Mukhtaar:

Translation: And there are four Takbeers in the Janaazah Salaah. Every Takbeer represents the Raka’at. He (Imam) will raise his hands only in the first Takbeer. (Durr e Mukhtaar volume 1, page 220, Darul Kutbul Ilmiyah Beirut).

It is in Fataawa Shaami:

Translation: This is an indication not to raise the hands during the Takbeer of Intaqaalaat (i.e. The Takbeers of Migration From One Raka’at or Posture to the Next). The views of Imam Shafi'i Alaihir Rahma and Imam Ahmad Alaihir Rahma are against it. Therefore, according to us (Hanafi), Rafe-yadain (raising both hands) is Makrooh (Tanzeehi) and it does not invalidate the Salaah. (Fataawa Shaami, Volume 2, page 340, Chapter of Salaah, Zia-ul-Quran Publications Lahore) It is in Noorul Idaah with Maraqi Al Falaah:

Translation: And according to Zaahir al-Riwaayah, the hands will not be raised in the Janaazah Salaah except for the first Takbeer. (Noorul Idaah with Maraqi Al Falaah, page 437, Darul kutbul Ilmiyah Beirut) It is in Fataawa Hindiyah:

Translation: According to the apparent narration, the hands will not be raised except for the first Takbeer. This is written in Ainee Sharh (explanation) of Kanz and the Imam and the Qaum (Muqtadi) are equal in this ruling. It is written in Kaafi. (Fataawa Hindiyah, volume 1, page 180, Darul kutbul Ilmiyah Beirut)

It is in Fataawa Razviyyah Shareef:

Translation: It is in Rahmaaniyah and in Tahtaawi that, Pronounce the opening Takbeer with the hands raised up to the ears, then recite the Thana, then say the Takbeer and recite Darood upon the Holy Prophet , then say the Takbeer and seek forgiveness for the deceased, then say the Takbeer and make Salaam. The hands should not be raised in the last three Takbeers. And there is no recitation of the Qur'an in a Funeral prayer. (Fataawa Razviyyah Shareef New Edition, Volume 9, page 190).

The Summary: From the above mentioned statements, it has become clear that in the case which has been queried, the funeral prayer (Janaazah Salaah) is valid, but it is against the Sunnah and it is Makrooh e Tanzeehi, therefore, the Sunni Hanafi scholar should refrain from deliberately offering the funeral prayer in this way.
