Child born out of wedlock being attributed to the mother
Question
If a child is born out of wedlock (through zina), and the biological father is ready to acknowledge his child and give him his surname, what is the Islamic ruling?
Answer
This child does not belong to the biological father, it belongs to the mother. Hence, the child should take the mother's name. Wrong attribution is haraam and incorrect.
And Allah Ta'ala (الله تعالى) knows best.

Fatawa SA is an independent, read-only index of fatawa already published by Mufti Online — Madrasah Ta'leemuddeen. It is not a fatwa service. For your own situation, ask the issuing Darul Ifta directly.
