Is it permissible to use toothpaste and mouthwash while fasting?

Question Posed By: Mahomed Reshard Ismail, Chatsworth Durban

Answer

Although it is not unlawful (Haraam), to use toothpaste or mouthwash in the state of fasting, it is definitely Makrooh without a valid reason. It is mentioned in Fataawa Faqih e Millat in response to a similar

question: "It is permissible to apply toothpaste or tooth-powder while one is fasting, provided one is sure that no part of it will go down beyond the throat. Yes, it is Makrooh. It is stated in Fataawa Razviyyah Shareef, Volume 4, Page Number 614: "Tooth-powder/paste is not unlawful or forbidden when there is full confidence (Yaqeen) that no part of it will go down the throat. However, without a valid need, it is definitely Makrooh (undesirable/disliked)" It is In Durr e Mukhtar:

Translation: "It is Makrooh for a fasting person to have a taste of anything." (Durr e Mukhtar with Shaami Volume 4, Page 122 - Book of Fasting - Zia-ulQuran Publications Lahore; Fataawa, Faqih e Millat Vol. I, Pg. 343 - Kitaab As -Saum).

It must be noted that here Makrooh means Makrooh e Tanzeehi, as it is in Fataawa Shaami:

Translation: Clearly (i.e. it is apparent), in these matters Karaahat means Makrooh e Tanzeehi. (Fataawa Shaami, Volume 4, Page Number 122)

Note: Makrooh e Tanzeehi: According to Urdu lexicographers, the word Makrooh e Tanzeehi is generally understood to mean: Makrooh of a lesser degree. • Disliked by Shari'at. • If done, there is no sin or punishment. (Fataawa Razviyyah Shareef) • It is bad to develop a habit of doing such deeds. • There is Sawaab (reward) if avoided. (Namaaz of Mo'min, Page 54, Chapter 1)

The Summary: It is Makrooh to use toothpaste while fasting, so one should avoid the use of toothpaste during fasting. Advice: It is better for the fasting person not to use toothpaste etc. while fasting. However, it is better to use toothpaste or mouthwash before dawn and use a Miswaak while fasting, as this is the Sunnah of our Beloved Prophet (Peace and Blessings of Allaah be upon him).
