Question

Assalaamualaikum respected mufti saheb

Trust that you are well. I would like to find out if the following products or services are allowed in our current South African context.

- Third party cover(car)

- Hospital plan

Third party cover is a service where if there is an accident, then they will cover the costs for the damages to the other car. In this instance the person won’t be held liable financially if there is a mistake and he damages another person’s car.

Hospital plan covers all procedures that need to occur in hospital. With our current ailing government hospital system, it many a times takes weeks and months before a person could receive the necessary treatment. Whereas the private hospitals have a quick turnaround time and less waiting period in the case of am emergency.

Answer

1.Yes there is allowance for 3rd party cover on the car. The condition for the 3rd party cover is that there should be no negligence at the time of the accident. If one was negligent in his driving then he will be liable.

2.Due to necessity and exorbitant medical fees, Fuqaha have given permission for Hospital Plan
