Giving an umrah trip as a prize

Question

Assalaamu alaikum ww Muhtaram Mufti saheb:

Could Mufti Saheb kindly advise on the following:

A group owning a store wishes to sponsor an umrah trip through a competition to customers. Is this allowed ? As the customers are not purchasing a once off “lottery ticket “ but because they purchase at the store regularly it is something that they can get rewarded with.

Wa alaykum salaam ,Respected Moulana

The answer to your query is as follows:

This form of competition does not necessitate any entry fee, rather the prize is like a gift to the winner, hence it is permissible.

لِأَنَّ الْقِمَارَ مِنْ الْقَمَرِ الَّذِي يَزْدَادُ تَارَةً وَيَنْقُصُ أُخْرَى، وَسُمِّيَ الْقِمَارُ قِمَارًا لِأَنَّ كُلَّ وَاحِدٍ مِنْ الْمُقَامِرَيْنِ مِمَّنْ يَجُوزُ أَنْ يَذْهَبَ مَالُهُ إلَى صَاحِبِهِ، وَيَجُوزُ أَنْ يَسْتَفِيدَ مَالَ صَاحِبِهِ وَهُوَ حَرَامٌ بِالنَّصِّ، وَلَا كَذَلِكَ إذَا شُرِطَ مِنْ جَانِبٍ وَاحِدٍ لِأَنَّ الزِّيَادَةَ وَالنُّقْصَانَ لَا تُمْكِنُ فِيهِمَا بَلْ فِي أَحَدِهِمَا تُمْكِنُ الزِّيَادَةُ، وَفِي الْآخَرِ الِانْتِقَاصُ فَقَطْ فَلَا تَكُونُ مُقَامَرَةً لِأَنَّهَا مُفَاعَلَةٌ مِنْهُ زَيْلَعِيٌّ (رد المحتار ٦/٤٠٣)
